How We Can Help You Make A Holiday Accident Claim

Ralli Solicitors has more than 40 years’ experience in helping holidaymakers recover the compensation they deserve after suffering an accident or illness.

We know that your experience is unique to you, but here are some common holiday accident claims we may be able to help you recover compensation for:

  • road traffic accidents – including car, scooter and cycling accidents, or accidents travelling in a bus, coach or taxi, whether you were a passenger, driver or pedestrian
  • accidents which occur on board a cruise ship
  • boat or sailing accidents
  • injuries sustained during water sports, skiing or other sporting and recreational activities (day trips)
  • injuries sustained whilst on the hotel or resort premises, such as a slip, trip or fall by the pool or on slippery or uneven surfaces
  • natural disaster, such as a tsunami or earthquake

If your accident isn’t described above, don’t worry, it’s highly likely we will still be able to help you.

What To Do If You Have An Accident Abroad

To support your holiday accident compensation claim, you will need to provide as much proof as you can.

You should:

  • Make sure you report the injury or accident to the relevant people e.g. hotel, B&B staff, tour rep or your travel company, at the time of the accident itself.
  • If there is an incident or log book, make a note of your accident, including the time and date.
  • Take contact details for any witnesses.
  • If possible, take photographs of the scene of the accident and your injuries as soon as possible after the incident.
  • If you have received medical attention, retain all medical records and a note of any recommendations and prescriptions.
  • It is useful if you can keep receipts for medical costs, travel expenses and any other charges resulting from your injury or illness.

We know that accidents can happen anywhere, which is why we strive to help you recover the compensation you deserve for an accident whilst on holiday wherever you are in the world.

Tracey Horton did an excellent job of bringing our claim to a successful conclusion and we would have no hesitation in calling on her services and that of Ralli Solicitors in the future.

The Law

Holiday accident compensation claims can be more difficult than other types of claims, as typically your claim may need to be made in the country of your accident, and, therefore, subject to the law of that country, which can affect your rights and the compensation awarded. Therefore it is important that you speak to solicitors who have the specific legal expertise in this complex area of law.

There are regulations and bodies set up to help people like you claim the compensation you deserve following an accident on holiday. The 1992 Package Travel, Package Holiday and Package Tour Regulation Act aids those who have travelled on a package holiday abroad to claim compensation for their injury in the UK.

It is much easier for you to bring a claim against a tour operator in the UK, than having the difficulty and expense of instructing foreign lawyers to pursue a legal action in the country where the accident occurred. The standards applied by the court will still be the standards that apply in the country where the accident occurred, so we may need to seek the assistance of a foreign expert as well.

Under the regulations the resort, tour operator and hotel owe a duty of care to provide you with a safe service whilst you and your family are on holiday.

Even if you were not on a package holiday, our specialist holiday accident claims solicitors can still help you.

Our sympathetic, compassionate solicitors understand how suffering an accident or illness whilst on holiday, can not only ruin your holiday at the time, but if seriously injured, this can drastically change the quality of your life. Our holiday claims solicitors will do everything we can to win you the holiday compensation you deserve, while keeping the process transparent and hassle-free. We may also be able to secure compensation to reimburse you for the fact that your holiday was affected because of the accident, and any related financial losses or expenses that you may have incurred, such as loss of earnings, medical costs or transport costs.

How To Claim Holiday Accident Compensation

If you have suffered an injury whilst on holiday, either abroad or in the UK, our specialist solicitors will do everything they can to achieve the best outcome for your holiday accident claim.

As holiday accident claims are very complex, our team can help advise you on whether you have a claim. If we decide to accept your claim, the claim will be submitted to the tour operator. If the accident happened abroad the tour operator will be given a longer period of time to investigate the claim (usually six months), so these claims can take longer to deal with.

Any claim will usually have to start within three years of the date of the accident (unless you are claiming on behalf of a child) but in light of the longer investigation period it is better to seek legal advice as soon as possible. However, if your accident involved passage on a boat or aeroplane you have only two years from the date of the accident to start your claim in the English courts.

Please call our holiday accident claim solicitors today for a free consultation on 0161 207 2020, request a call back or use our online enquiry form and one of our dedicated team members will call you back as soon as they can.
