What To Do If You Have An Accident Abroad
To support your holiday accident compensation claim, you will need to provide as much proof as you can.
- Make sure you report the injury or accident to the relevant people e.g. hotel, B&B staff, tour rep or your travel company, at the time of the accident itself.
- If there is an incident or log book, make a note of your accident, including the time and date.
- Take contact details for any witnesses.
- If possible, take photographs of the scene of the accident and your injuries as soon as possible after the incident.
- If you have received medical attention, retain all medical records and a note of any recommendations and prescriptions.
- It is useful if you can keep receipts for medical costs, travel expenses and any other charges resulting from your injury or illness.

Holiday accident compensation claims can be more difficult than other types of claims, as typically your claim may need to be made in the country of your accident, and, therefore, subject to the law of that country, which can affect your rights and the compensation awarded. Therefore it is important that you speak to solicitors who have the specific legal expertise in this complex area of law.
There are regulations and bodies set up to help people like you claim the compensation you deserve following an accident on holiday. The 1992 Package Travel, Package Holiday and Package Tour Regulation Act aids those who have travelled on a package holiday abroad to claim compensation for their injury in the UK.
It is much easier for you to bring a claim against a tour operator in the UK, than having the difficulty and expense of instructing foreign lawyers to pursue a legal action in the country where the accident occurred. The standards applied by the court will still be the standards that apply in the country where the accident occurred, so we may need to seek the assistance of a foreign expert as well.
Under the regulations the resort, tour operator and hotel owe a duty of care to provide you with a safe service whilst you and your family are on holiday.

How To Claim Holiday Accident Compensation

As holiday accident claims are very complex, our team can help advise you on whether you have a claim. If we decide to accept your claim, the claim will be submitted to the tour operator. If the accident happened abroad the tour operator will be given a longer period of time to investigate the claim (usually six months), so these claims can take longer to deal with.
Any claim will usually have to start within three years of the date of the accident (unless you are claiming on behalf of a child) but in light of the longer investigation period it is better to seek legal advice as soon as possible. However, if your accident involved passage on a boat or aeroplane you have only two years from the date of the accident to start your claim in the English courts.
